1 – Definitions
In these terms and conditions meanings:
A. Reflection period: the period within which the consumer can make use of his right of withdrawal;
B. Consumer: the natural person who does not act for purposes related to his trade, business, craft or professional activity;
C. Entrepreneur: E. Gubbels Pipe Cleaner BV;
D. Right of withdrawal: the possibility for the consumer to refrain from the contract within the period of reflection;
E. Model revocation form: the European standard withdrawal form as set out in the annex to this condition.

3 Applicability / Web environment
A. These general terms and conditions apply to any use of the website www.bigben.nl
B. The company shall ensure a safe and secure web environment.
4-The Offer / Agreement
A. The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable a good assessment of the offer. The images of the products are a true representation of the products offered. Obvious mistakes or manifest errors in the offer do not bind the entrepreneur.
B. The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfilment of the conditions. The trader immediately confirms receipt of acceptance of the offer. As long as the receipt of acceptance has not been confirmed by the trader, the consumer can rescind the agreement.
5 Right of withdrawal/ Obligations
A. The consumer may dissolve an agreement with respect to the purchase of a product during a reflection period of at least 14 days.
B. The period of reflection referred to in paragraph A shall be the day after the consumer has received the product.
C. During the reflection period, the consumer will deal with the product carefully. He will only use the product to determine the nature, characteristics and operation of the product. The purpose of the reflection period is that the consumer can only use and inspect the product as he should do in a shop.
6-Exercise of right of withdrawal Consumer Entrepreneur
A. If the consumer uses the right of withdrawal, he will report this to the entrepreneur within the period of reflection.
B. As soon as possible, but at the latest within 14 days of the day following the notification referred to in paragraph A, the consumer shall return the product to the entrepeneur.
C. The consumer shall return the product with all supplied accessories, if reasonably possible in original condition and packaging and in accordance with the reasonable and clear instructions provided by the trader.
D. The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
E. The consumer shall bear the direct costs of returning the product.
F. The consumer bears the risk during the transport.
G. If the consumer makes use of his right of withdrawal, all additional agreements shall be dissolved automatically.
H. The trader shall immediately send a confirmation of receipt after notification of revocation by the consumer.
I. The trader shall pay the consumer's payments for the returned product without delay, but within 14 days following the day on which the consumer invokes revocation. The trader may wait with a refund until he has received the product or demonstrates to the consumer that he has returned the product.
7-Price
The prices quoted in the offer of the products are inclusive of VAT and excluding shipping costs.
Shipping costs depend on zone and are reported in advance.
8-Payment

9-Compliance Agreement and additional guarantee
A. The entrepreneur will observe the utmost care when receiving and executing the order.
B. The place of delivery shall be the address which the consumer has made known to the trader.
C. The entrepreneur will execute the accepted orders, with the competent urgency but no later than 30. If the delivery is delayed, or the agreement can only be partially executed, the consumer will receive a notice no later than 30 days after placing the order. In that case, the consumer has the right to dissolve the contract at no cost.
D. After the termination in accordance with the previous paragraph, the trader shall immediately repay the amount paid by the consumer.
E. The risk of damage and/or loss of products rests with the trader until the moment of delivery to the consumer.
10 -Complaints system
A. The trader has a sufficient complaints procedure and treats the complaint in accordance with this procedure.
B. Complaints about the implementation of the contract must be made fully and clearly to the trader within a reasonable time after the consumer has found the defects.
C. Complaints submitted to the trader shall be answered within a period of 14 days from the date of receipt, unless the complaint is demonstrably requiring a longer processing time.
11-Disputes
Agreements between the trader and the consumer to which these general terms and conditions relate are governed exclusively by Dutch law.
12-Additional or other provisions
The company reserves the right to change these terms and conditions at any time. Such changes will take effect immediately upon posting of the terms and conditions on this site.
